Device deployment

The dashboard camera is provided free of any upfront purchase cost. Ownership remains with Techealth Apex Private Limited at all times. The client receives a limited, non-transferable, non-exclusive right to use the device only in the vehicle specified in this agreement.

Annual Maintenance Charge (AMC)

Rs. 1,500/- per device per year, payable in full in advance at the start of each annual cycle. Techealth may revise the AMC with 30 days' written notice prior to renewal.

Data collection & privacy

The device collects video footage, GPS/route data, speed/acceleration/braking metrics, driver behaviour analytics, and road condition data. This data may be used for service improvement, AI/ADAS training, and (in anonymised/aggregated form only) shared with insurers, automotive OEMs, and mapping platforms. Personal identity is never individually disclosed. Data protection complies with the DPDPA, 2023. The client may withdraw consent in writing; withdrawal constitutes termination.

Warranty

One (1) year from date of installation, covering manufacturing defects and technical malfunctions not caused by physical damage, tampering, water exposure, misuse, or external impact. Doorstep repair or replacement at no additional cost during the warranty period. Warranty is void if device is tampered with or modified.

Client responsibilities

Do not tamper with, modify, reverse-engineer, or disassemble the device. Allow Techealth access for installation, maintenance, inspection, or retrieval. Use the device only in the specified vehicle. Report malfunctions, damage, or theft promptly. Do not expose the device to physical impact, water, or extreme heat.

Non-payment & deactivation

Non-payment of AMC may result in temporary deactivation without prior notice. If deactivated for more than 3 continuous months, Techealth may terminate this agreement and repossess the device.

Damage liability

If the device is found physically damaged, tampered with, or non-functional due to the client's misuse or negligence, a penalty of Rs. 6,000/- or 100% of the prevailing replacement cost (whichever is higher) applies. Theft or loss due to client negligence is treated as damage. The client will receive 7 days' written notice before the penalty is levied.

Limitation of liability

Techealth's aggregate liability shall not exceed the total AMC paid in the preceding 12 months. Techealth is not liable for any indirect, consequential, or punitive loss.

Agreement duration

Five (5) year initial term from date of installation, automatically renewed annually on AMC payment. Either party may terminate with 30 days' written notice.

Governing law & disputes

Governed by the laws of India. Disputes first resolved by good-faith negotiation (30 days), then by sole-arbitrator arbitration in New Delhi per the Arbitration and Conciliation Act, 1996.
